National Shipping Company acts as a licensed Customs Broker in India and provides services including, but not limited to:

  • Calculation and payment of duties, taxes, and other charges
  • Liaison with customs authorities and other government agencies
  • Advisory services on customs-related matters

All services are provided in accordance with the Customs Act, 1962 and the Customs Brokers Licensing Regulations, 2018.

4. Client Obligations

  • Accuracy of Information: You warrant that all information and documentation provided to us, including descriptions, values, and origins of goods, are true, complete, and accurate. You agree to indemnify us against any claims, losses, or penalties arising from any inaccuracies or omissions.
  • Know Your Customer (KYC): In compliance with Indian regulations, you are required to provide necessary KYC documents for verification of identity and address.
  • Compliance with Laws: You are responsible for ensuring that your goods comply with all applicable Indian laws and regulations, including any prohibitions or restrictions.
  • Timely Communication: You must provide all necessary documents and information in a timely manner to avoid delays in the clearance process.
  • Prohibited Goods: You must not attempt to ship restricted or prohibited items under Indian law. Any such attempts may result in penalties, seizure of goods, or legal action.

5. Company’s Role and Limitation of Liability

  • Agent: We act as your direct agent in dealing with customs authorities. Our liability is limited to that of an agent.
  • No Guarantee of Clearance: While we will use our best efforts to ensure a smooth clearance process, we do not guarantee the timing or outcome of customs inspections or decisions.
  • Third-Party Services: We may engage third-party service providers (e.g., transporters, warehouses). We are not liable for the acts or omissions of such third parties.
  • Financial Limit: Our liability for any loss, damage, or delay shall not exceed the total professional fees paid by you for the service in question. We are not liable for consequential losses.

6. Quotations and Fees

All quotations for fees, duties, and other charges are estimates and are subject to change. Final charges will be based on the actual services rendered and the duties and taxes assessed by customs authorities.

All invoices are payable upon receipt unless otherwise agreed in writing. All fees are quoted in Indian Rupees unless stated otherwise. Late payments may incur interest as per agreed terms or prevailing law.

7. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts at Mumbai, Maharashtra.
